NINE NEW ARIZONA GUN LAWS IN EFFECT ON SEP. 30
NINE NEW ARIZONA GUN LAWS IN EFFECT ON SEP. 30
Arizonans have nine new gun laws to learn about, all of them good, and plain-English descriptions of them are posted at https://www.gunlaws.com/AGOG2009.htm.
An easy-to-print sheet is available for free download at that site, and can be inserted into The Arizona Gun Owner's Guide to bring it up to date.
The new 24th edition of The Arizona Gun Owner's Guide is expected out soon. All orders received for the book will be held until the new edition is released. If you order on the web, you can request an autographed copy in the "Comments" box on the secure order page.
The push to increase burdens and restrictions on innocent gun owners were all beaten back this year. Help beat them back next year, https://www.gunlaws.com/links. Though some good gun-rights bills were defeated, the enacted laws are generally supportive of your constitutional right to keep and bear arms. They are:
HB 2532 Limited restoration of rights for people no longer deemed incompetent
HB 2569 New penalty for smuggling people for profit, involving a deadly weapon
SB 1113 CCW in liquor-serving places OK without drinking, unless no-gun signs
SB 1088 Domestic violence protection extended to romantic or sexual partners
SB 1168 Parking lots cannot ban firearms locked in vehicles, with exceptions
SB 1242 Exemptions from CCW and more for more "proper authorities"
SB 1243 Defensive display of a firearm in self defense defined and protected
SB 1437 AZ High School Marksmanship Program instructor definition expanded
SB 1449 Retroactive self-defense clarification (Harold Fish law)

ACLU Success Has Surprise -- It Helps Gun Owners
ACLU Success Has Surprise -- It Helps Gun Owners
Despite claiming to defend the Bill of Rights, the ACLU is generally no friend of gun owners -- their meetings sometimes look like "hoplophobes are us." But one ACLU program turns out to have a hidden benefit for your gun rights -- arbitrary roadside searches will now be severely limited in Arizona.
A review of data showed that black and Hispanic drivers were asked for consent to search their vehicles 2-1/2 times more often than white drivers, and that the people of color were more likely than colorless people to consent to those searches. As a result of an ACLU lawsuit (Arnold v. DPS), a nine-member Citizen Traffic Stop Advisory Board was set up, and DPS has now agreed to policy changes regarding "consent searches."
In the agreement reached late last year and announced in an ACLU newsletter earlier this year, DPS has agreed to, "the revision of department orders, operating instructions, and officer training materials to require that officers have reasonable suspicion of criminal activity before asking a driver for consent to search a vehicle." Implemented to address racial discrimination, the benefits for gun owners -- and everyone -- are obvious.
Under the new rules, "officers may not conduct a consent search unless the driver's or passenger's consent is physically documented, either by a signature on a Consent to Search Form or an audio or video recording of the person giving consent." The days of casual but coercive requests to search, at least for DPS, are over.
Officers will be required to write down the reasons for their reasonable suspicion prior to requesting consent to search, for review by their superiors. The ACLU notes that some other jurisdictions have banned suspicionless consent searches, including New Jersey, Minnesota and Rhode Island, a trend that ought to spread nationwide.
City police take cues from DPS, but are not required to follow DPS policy, so drivers still need to cautiously guard their rights in a request for consent to search.
And note the somewhat sneaky tactic glossed over in the policy -- gaining permission from a passenger. A driver may be reluctant to allow a fishing-expedition search, but if the driver steps away, officers can and do ask passengers for permission and sometimes succeed where they otherwise would not. Boston T. Party's book You And The Police covers your rights in a search, your right to refuse consent, and related matters when dealing with the police.
ARIZONA HAS IMPORTANT NEW GUN-RIGHTS "PAC"
ARIZONA HAS IMPORTANT NEW GUN-RIGHTS "PAC"
The Arizona Citizens Defense League (AzCDL) has formed the AzCDL Political Action Committee (PAC).
AzCDL has been crucial in crafting and passing excellent gun laws in the state, and stopping bad laws from moving. These are true gun guys through and through, fighting for our rights. They've done great with legislation, but they have not been able to support or oppose candidates because election laws prohibit them. The PAC fixes that.
The PAC will focus entirely on candidates for the Arizona legislature or other statewide offices, like the governor or attorney general (but it cannot act on local elections -- county, city, town, etc., or federal offices). By actively supporting pro-rights candidates, and opposing anti-rights candidates, your gun rights will be better protected. This new PAC deserves your support. This is exactly what we need. Learn more: http://www.azcdlpac.com/index.html
Take it from me, these people have their heads on straight. What a PAC needs most is money, that's where the influence comes from, so they're asking for donations. Even a small amount adds up and will make a difference between candidates who support your right to keep and bear, and those who would disarm you. http://www.azcdlpac.com/contribute.html. You should join them, and similar groups, if you haven't already: https://www.gunlaws.com/links
Are you set to attend the AzCDL Annual Meeting in Tucson this Saturday, Oct. 3 at noon? Tremendous gun-rights pow wow, top gun-rights legislators there in person, The Cartridge Family Band, unlimited BBQ buffet banquet, be there or be square. Make a PAC contribution there in front of your allies. RSVP right quick, it's almost full: http://www.azcdl.org/html/annual_mtg.html
OUTDOOR MARKSMANSHIP NEEDS SUPPORT
OUTDOOR MARKSMANSHIP NEEDS SUPPORT
One of the last remaining spots for outdoor marksmanship near Phoenix is the Table Mesa Road area off highway I-17. The Bureau of Land Management has been eyeing this popular spot and holding meetings about its future. This memo from an Arizonan explains what's up, and deserves your support, contact him directly if you can help:
Mr. Korwin, My name is Jason Siffring, we had met at the public meeting for BLM's planning of the Table Mesa recreation area. Now over the past few months a group of us have formed a group called TMAC, the Table Mesa Area Coalition. For our opening activity we are organizing a group clean up of the area, and being the lone shooter in the group of off roaders and ranchers -- most all of which hate the shooters to some level -- I would like to ask your help.
If you could please include in your newsletter for all shooters who use the area at all that there will be a clean up of the area on Saturday October 24. It's posted on http://www.fotablemesarecarea.org/Home_Page.html our web site for now. The shooters have a very small presence in the organization and I would love for as many shooters as possible to attend and help increase our presence at the event. Please feel free to contact me with any questions and of course THANK YOU VERY MUCH. Jason Siffring siffringjason@gmail.com
